To purchase cryptocurrency on the Platform, you must also be the legal owner of the payment card used during the transaction process.

ACCOUNT REGISTRATION

To access the Platform and use the Services, you must register for an account (the “Account”). By registering, you confirm that you meet the eligibility criteria.

During registration, you must provide accurate and complete information, including your name, email address, and government-issued identification. You may be required to provide additional documents. By registering, you agree to our Privacy Policy, which governs how we collect, use, and share your personal data.

You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify Hashdale immediately if you suspect any unauthorized access or activity involving your Account.

DOCUMENTS AND INFORMATION

GIANTBIT reserves the right to request additional documents and information at any time to better understand the purpose of your relationship with us, including data obtained through third-party services.

Failure to provide this information, or the detection of money laundering indicators, may result in GIANTBIT refusing to open an account or terminating the Services. Please refer to our Anti-Money Laundering and Know-Your-Customer Notice for details on how we prevent illegal activities like money laundering.

GENERAL RIGHTS AND OBLIGATIONS

User Rights:

As a user of our Platform, you have the right to:

  • Access and use the Platform's Services if you meet eligibility criteria and comply with these Terms.

  • Exchange your cryptocurrency for other currencies supported by the Platform.

  • Withdraw cryptocurrency to an external wallet after completing an order.

  • Manage your Account, including transaction history.

  • Request support and assistance from our customer service team when necessary.

User Obligations:

You agree to:

  • Provide all requested information when creating an Account or upon request. You represent that the information you provide is accurate, truthful, and up to     date.

  • Take necessary steps to secure your Account credentials and notify Hashdale immediately if you suspect any unauthorized access.

  • Use the Platform in accordance with these Terms and other policies.

  • Avoid engaging in any illegal activity or any action that disrupts the Platform's operations.

  • Comply with all applicable laws and regulations.

GIANTBIT RIGHTS AND OBLIGATIONS

Giantbit Rights:

Giantbit reserves the right to accept or reject your registration at its discretion.

  • Giantbit may restrict or terminate your access to the Platform without prior notice.

  • Giantbit can reject any transaction, impose limits, or modify the Services without prior notice.

  • Giantbit retains the right to alter or remove content on the Platform at any time.

Giantbit Obligations:

You agree to:

  • Giantbit will provide Services in accordance with these Terms.

  • Giantbit will ensure the Site is operational except for temporary interruptions due to maintenance or technical issues.

  • Giantbit will provide transparent trading information.

  • Giantbit will comply with regulatory requirements, including implementing AML and KYC measures.

  • Giantbit will provide customer support as needed.   • Giantbit will comply with applicable laws and regulations.

VIRTUAL CURRENCY EXCHANGE SERVICE

Giantbit offers virtual currency exchange services, allowing users to buy and sell cryptocurrencies such as BTC, TRX, and USDT in exchange for fiat currencies (EUR and USD). Users can submit orders via the Platform to trade these cryptocurrencies.

The availability of certain Platform features or Services may vary depending on the user's place of residence, and it is the user's responsibility to comply with all applicable local laws and regulations.

To place an order, the user must log into their Account, specify the amount and currency to exchange, choose the cryptocurrency to buy or sell, and provide an external crypto wallet address. Payments are processed via debit or credit card, and the transaction will appear as Giantbit on the user's bank statement.

TRANSACTIONS POLICY

Card Verification:

When purchasing cryptocurrency with a card, users must provide card details (card number, expiration date, and CVV). By submitting this information, you authorize Giantbit and its payment processors to charge your card and receive payment on your behalf.

Transaction Limits:

For card transactions, the minimum purchase amount is 5 EUR or its equivalent in USD.

FEES

You agree to pay applicable fees for all cryptocurrency transactions on the Platform. These fees will be displayed before completing each transaction and include:
  • Processing Fee: Varies depending on the payment method.

  • Platform Fee: Charged for using the Platform's services.

  • Network Fee: A fee required for blockchain transactions, based on market conditions.

Fees for buying cryptocurrency include:
  • Processing Fee:
        o Cards: 2.5% to 6.6% + EUR 0.45
        o Open banking/Sofort: 1.8% + EUR 0.45

  • Platform Fee: Up to 0.25%.

  • Network Fee: Waived (minimum fee of 0.000053 BTC / 7 USDT ERC20 / 4 USDT TRC20).

Fees for selling cryptocurrency include:
  • Processing Fee:
        o SEPA: EUR 1.00.

The network fee is influenced by factors such as blockchain demand, cryptocurrency type, and regulatory requirements.

TAXES

You are responsible for determining whether taxes apply to your cryptocurrency transactions through the Platform and for reporting and paying those taxes to the relevant authorities. Giantbit is not responsible for determining, collecting, reporting, or withholding taxes related to your transactions.

CANCELLATIONS AND REFUNDS

All transactions conducted through the Platform are final and non- refundable. You may cancel an order before the transaction is executed by sending a request to [contact email address].

Giantbit reserves the right to cancel orders if card verification fails, a user violates the Terms, or technical issues prevent processing the order.

INTELLECTUAL PROPERTY

All content and materials on the Platform, including but not limited to text, graphics, logos, and images, are the property of Giantbit or its licensors and are protected by copyright and trademark laws. Users may not use any content for commercial purposes without express written consent from Giantbit.

Users are prohibited from altering, copying, reproducing, distributing, transmitting, publishing, or selling any content or materials from the Platform without permission.

RISK DISCLOSURE

By using the Platform and Services, you acknowledge and agree to the following risks associated with cryptocurrency transactions:

  • Market Volatility: Cryptocurrencies are highly volatile and can experience significant fluctuations in value over short periods. You understand that engaging in     cryptocurrency transactions involves a high level of risk, including the potential loss of your entire investment.

  • Regulatory Risk: The regulatory environment surrounding cryptocurrencies is evolving, and changes in laws, regulations, or policies may adversely affect your     ability to use the Platform or trade cryptocurrencies. You are responsible for understanding and complying with all applicable regulations in your jurisdiction.

  • Technology Risk: Blockchain technology is still in its developmental phase and may be subject to unforeseen technical challenges. Issues such as hacking,     software bugs, network failures, or vulnerabilities in smart contracts may affect the functionality and security of cryptocurrency transactions.

  • Liquidity Risk: Some cryptocurrencies may have limited liquidity, and you may not be able to sell or exchange them promptly without significantly affecting     the price.

  • Operational Risk: The operation of our Platform may be impacted by third-party service providers, such as banks, payment processors, and liquidity     providers, who may experience delays, technical issues, or service interruptions beyond our control.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, you understand and agree that Giantbit, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Platform or Services, including but not limited to:

  • Loss of profits or revenue;

  • Loss of data, funds, or cryptocurrency;

  • Loss of goodwill or business reputation;

  • Unauthorized access to your Account or data;

  • Any technical failures or errors of the Platform or Services;

  • Delays or interruptions in the availability or transmission of Services.

In no event shall Giantbit’s total aggregate liability exceed the amount of fees paid by you to Giantbit for the Services in the three months preceding the event that gave rise to the claim.

You acknowledge that the Platform provides a marketplace for trading cryptocurrencies, which are subject to market volatility and legal risks. Giantbit does not guarantee the success of any transaction or investment and shall not be liable for any losses incurred as a result of using the Platform or Services.

FORCE MAJEURE

Giantbit shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, strikes, labor disputes, embargoes, government actions, pandemics, network failures, or other major disruptions.

In such an event, Giantbit will make reasonable efforts to notify you of the situation and resume performance of the Services as soon as possible.

DISCLAIMER OF WARRANTIES

The Platform and Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, whether express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement.

  •Warranties of availability or error-free operation of the Platform and Services.

  • Warranties regarding the accuracy or timeliness of any content, data, or materials available through the Platform.

  • Warranties of security: Although Giantbit takes security measures to protect your data, we do not warrant that our Platform or Services will be immune from     unauthorized access, data breaches, hacking, or other malicious activity.

You acknowledge and accept that your use of the Platform is at your own risk, and you assume full responsibility for any risks associated with the use of cryptocurrencies and blockchain technologies.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Hashdale, its affiliates, officers, employees, agents, and contractors from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of the Platform or Services.

  • Your violation of these Terms.

  • Your violation of any applicable laws or regulations.

  • Any disputes or issues arising from transactions between you and third parties through the Platform.

  • Any fraud or illegal activity conducted using your Account, whether with or without your knowledge.

AML AND KYC COMPLIANCE

Giantbit complies with applicable Anti-Money Laundering (AML) and Know Your Customer (KYC) laws and regulations within the EU. By using our Platform, you agree to comply with all AML and KYC requirements, including providing accurate, up-to-date information and supporting documentation when requested.

Failure to comply with AML or KYC requirements may result in the suspension or termination of your Account and the freezing of any associated funds.

Giantbit reserves the right to monitor and report any suspicious activity to relevant authorities as required by law.

TERMINATION

Giantbit reserves the right to terminate or suspend your access to the Platform at its sole discretion, without prior notice, if:

  • You violate these Terms or any applicable laws.

  • You engage in any fraudulent or illegal activity.

  • Giantbit detects suspicious activity related to your Account.

  • There are technical or security reasons requiring termination.

Upon termination, any pending transactions may be canceled, and your access to your Account may be restricted. Giantbit is not liable for any losses incurred due to the termination of Services.

GOVERNING LAW AND JURISDICTION

These Terms, along with any disputes or claims arising out of or in connection with their subject matter, shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of Warsaw, Poland. By using the Platform, you hereby submit to the jurisdiction of such courts and waive any objection to venue or jurisdiction.
